Senate Bill 367 as introduced creates the Medicaid False Claims Act. This bill will increase the administrative obligations of the Attorney Generalís Office to investigate and prosecute violations as provided by the bill. The increased obligations may be offset in part by courts costs awarded for successful prosecution of violations under the bill. Additionally, this bill authorizes civil penalties against persons making false claims or persons who commit fraud against the Alabama Medicaid Agency. This will increase receipts to the State General Fund by an undetermined amount dependent upon the number of persons violating the provisions of this bill and the amount of the civil penalty assessed ranging between $5,500 and $11,000 per fine; and increase receipts to the State General Fund by an undetermined amount from damages awarded against persons who are found to have committed a violation against the Alabama Medicaid Program in civil court.
