House Bill 394 as introduced could increase receipts to the State General Fund by an undetermined amount, dependent upon the funds remaining from criminal asset forfeiture sales, resulting from a criminal conviction for a drug related offense, after disbursements for: (1) victim restitution; (2) payments for outstanding liens, mortgages, or filed security interests in the forfeited property; (3) payments for reasonable costs associated with the sale and maintenance of the forfeited property; (4) reimbursements to the seizing law enforcement agency for non-personnel operating costs; and (5) reimbursements to the prosecuting authority for non-personnel operating costs.
