SYNOPSIS:This bill would propose an amendment to the Constitution of Alabama of 1901, to provide for a ten year road and bridge construction program to be funded with withdrawals from the Alabama Trust Fund.

A BILL
TO BE ENTITLED
AN ACT

To propose an amendment to the Constitution of Alabama of 1901, to provide for a ten year road and bridge construction program to be funded with withdrawals from the Alabama Trust Fund.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The following amendment to the Constitution of Alabama of 1901, as amended, is proposed and shall become valid as a part thereof when approved by a majority of the qualified electors voting thereon and in accordance with Sections 284, 285, and 287 of the Constitution of Alabama of 1901, as amended:

PROPOSED AMENDMENT

Beginning on or about January 1, 2010 the Board of Trustees of the Alabama Trust Fund shall transfer from the Alabama Trust Fund a total of $100,000,000 to be distributed as provided in subdivisions 1 and 2 below. A transfer of this same amount shall be made on or about January 1 of each succeeding year through January 1, 2019 and is also to be distributed as provided in subdivisions 1 and 2 below.

(1) Seventy-five percent of the annual transfer from the Alabama Trust Fund shall be appropriated by the Legislature to the Department of Transportation for state highways, roads, and bridges and other transportation purposes to be further allocated as follows:

a. Not less than twenty-five percent of this amount shall be used for maintenance and repairs.

b. At least five million dollars ($5,000,000) of this amount shall be used in each congressional district in this state as these districts exist on the effective date of this amendment.

(2) The remaining twenty-five percent shall be distributed to the several counties of this state in the same manner as the $.04 per gallon gasoline tax is distributed in Code of Alabama 1975, Section 40-17-223 and is to be used for new construction and maintenance and repair and let at the county level.

In all other respects, the terms and provisions of Amendment 666 to the Constitution of Alabama of 1901, as amended, are unchanged and remain in full force and effect.

Section 2. An election upon the proposed amendment shall be held in accordance with Sections 284 and 285 of the Constitution of Alabama of 1901, now appearing as Sections 284 and 285 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Proposing an amendment to the Constitution of Alabama of 1901, as amended, relating to the Alabama Trust Fund, to provide for the transfer of funds in the Alabama Trust Fund over a 10 year period to be distributed for state transportation purposes.

"Proposed by Act ________."

This description shall be followed by the following language:

"Yes ( ) No ( )."
