ACCEPTING ALL FEDERAL STIMULUS FUNDS ALLOCATED TO ALABAMA FOR UNEMPLOYMENT COMPENSATION COVERAGE.
WHEREAS, H.R. 1, Public Law 111-5, the American Recovery and Reinvestment Act of 2009, commonly referred to as the Federal Economic Stimulus Package, provides in subsection (a) of Section 1607 that not later than 45 days after the enactment of the act, for any funds provided to a state, the Governor of the state must certify that (1) the state will request and use the funds provided by the act; and (2) the funds will be used to create jobs and promote economic growth; and
WHEREAS, subsection (b) of Section 1607 provides, "If funds provided to any State in any division of this Act are not accepted for use by the Governor, then acceptance by the State legislature, by means of the adoption of a concurrent resolution, shall be sufficient to provide funding to such State"; and
WHEREAS, subsection (c) of Section 1607 provides, "After the adoption of a State legislature's concurrent resolution, funding to the State will be for distribution to local governments, councils of government, public entities, and public-private entities within the State either by formula or at the State's discretion"; and
WHEREAS, the Governor of Alabama has indicated that he may not request all of the federal stimulus funds dealing with unemployment compensation and the Legislature has determined that accepting the funds is in the interests of the people of the state; now therefore,
BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH HOUSES THEREOF CONCURRING, That if the Governor of Alabama does not request or accept all federal stimulus funds allocated for Alabama for unemployment compensation coverage, the Legislature of Alabama, by the adoption of this concurrent resolution, accepts all federal stimulus funds allocated to Alabama for unemployment compensation coverage.
BE IT FURTHER RESOLVED, That a copy of this resolution be forwarded to the appropriate federal officials.
