To amend Section 16-40-1, Code of Alabama 1975, relating to physical education in public and private schools; to further provide for the physical education program in the schools.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 16-40-1, Code of Alabama 1975, is amended to read as follows:§16-40-1.
"(a) Every public school and private school, except church schools as defined in Section 16-28-1, shall carry out a system of physical education, the character of which shall conform to the program or course outlined by the Department of Education and which meets the requirements of this section.
"(b) Beginning with the 2010-11 school year, all students in grades K-8 shall take physical education which may include dance class if taught at a magnet school without allowing any substitution. which may include marching band, JROTC, or other activity as approved in the student's IEP."
Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
