SYNOPSIS:Under existing law, the salaries of certain board of education employees are not subject to proration.
 This bill would provide that the portion of the salaries received from extracurricular activity by K-12 employees would be subject to proration.

A BILL
TO BE ENTITLED
AN ACT

To amend Section 16-6B-9, Code of Alabama 1975, relating to the salary of local educators; to provide that the portion of the salaries received from extracurricular activity by K-12 employees would be subject to proration.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 16-6B-9 of the Code of Alabama 1975, is amended to read as follows:

§16-6B-9.

"(a) No funds shall be transferred by any board of education from salary allocations to any other expenditure or for any other purpose. In times of proration, salaries shall not be subject to proration, except for the portion of the salary received from extracurricular activity by K-12 employees.

"(b) For purposes of this section, the term extracurricular activity means any public school-sponsored activity not related to a student's academic requirements for which a teacher, sponsor, or coach is provided a supplemental salary or stipend and which is held or conducted beyond the regular school day. Extracurricular activities associated with athletics means those activities recognized and sanctioned by the Alabama High School Athletic Association."

Section 2. This act shall be read in pari materia with Section 16-13-144, Code of Alabama 1975, providing for school budgets, and Section 41-4-90, Code of Alabama 1975, providing for the effect of proration on appropriations.

Section 3. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
