To prohibit membership and retirement credit in the Teachers' Retirement System being earned by administrators, teachers, and support personnel whose place of work is outside the State of Alabama and to prohibit retirement contributions being submitted for salary earned for classes that are taught by mail or electronic means outside the State of Alabama.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. (a) No teacher, support employee, or employee as defined in Section 16-25-1, Code of Alabama 1975, shall be allowed membership in the Teachers' Retirement System of Alabama while being employed at a location outside the boundaries of the State of Alabama that is used to provide instruction to students for an institution that is a member of the Teachers' Retirement System.
(b) No retirement contributions shall be allowed for salary or service credit on salary earned on services administrated outside the State of Alabama for correspondence courses and on-line courses to students residing outside the State of Alabama by in-state instructors.
(c) The provisions of this act shall be applicable to new employees employed at Distance Learning Centers located outside the State of Alabama after October 1, 2010.
Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
