SYNOPSIS:Under existing law, every public school and private school, except a church school, is required to carry out a system of physical education.
 This bill would, effective for the 2009-10 school year, require all students in grades K-8 to take physical education without substitution.

A BILL
TO BE ENTITLED
AN ACT

To amend Section 16-40-1, Code of Alabama 1975, relating to physical education in public and private schools; to further provide for the physical education program in the schools.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 16-40-1, Code of Alabama 1975, is amended to read as follows:

§16-40-1.

"(a) Every public school and private school, except church schools as defined in Section 16-28-1, shall carry out a system of physical education, the character of which shall conform to the program or course outlined by the Department of Education and which meets the requirements of this section.

"(b) Beginning with the 2010-11 school year, all students in grades K-8 shall take physical education without allowing any substitution."

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
