|SYNOPSIS:||Under current law, it is a primary offense for front seat passengers in a moving vehicle to fail to wear a safety belt.|
|This bill would only allow citations for safety belt violations if the person is stopped for a separate violation of the law and is issued a ticket for the separate violation.|
Relating to safety belt citations; to add Section 32-5B-6.1 to the Code of Alabama 1975, to provide that a citation for failure to wear a seat belt while a motor vehicle is in motion may be issued only if the person is stopped for a separate violation of the law and issued a ticket for the separate violation.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 32-5B-6.1 is added to the Code of Alabama 1975, to read as follows:
Notwithstanding any provision of law to the contrary, only a warning citation may be issued for a violation of this chapter unless a person is stopped by a law enforcement officer for a separate violation of law and is issued a citation or warrant for arrest for the separate violation of law in which case a citation or warrant for arrest may be issued.
Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
